1. Agreement to Terms

By accessing or using VibeStory's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Use of Service

VibeStory provides AI-powered video generation services. You may use our Service to create short-form video content subject to these Terms and our Acceptable Use Policy.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Create content that infringes on intellectual property rights
• Generate harmful, offensive, or misleading content
• Attempt to circumvent any Service limitations or security measures
• Resell or redistribute the Service without authorization

3. Account Terms

You are responsible for maintaining the security of your account and password. VibeStory cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. Payment, Cancellation and Refunds

Certain aspects of the Service are provided on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

Subscription Cancellations

You can cancel your subscription at any time through your account settings or by contacting support.

• Cancellations take effect at the end of the current billing period
• You retain access to the service until the end of your paid period
• Unused credits do not carry over after cancellation
• No partial refunds for unused time in the current billing period

Refund Policy

We offer refunds under the following conditions:

• Request made within 14 days of purchase
• Less than 20% of monthly credits have been used
• No violation of our Terms of Service or Acceptable Use Policy
• First refund request for the account

How to Request a Refund

To request a refund, email support@vibestory.ai with your account email and order number. Our support team will respond within 24-48 hours. You can also call (669) 362-8103 for immediate assistance.

Once approved, refunds are typically processed within 5-7 business days and will be credited to the original payment method.

Credit Packs and Add-ons

One-time credit pack purchases:

• Refundable within 7 days if completely unused
• No partial refunds for partially used credit packs
• Credits expire 12 months from purchase date

Disputes and Chargebacks

Please contact us first if you have any issues with your purchase. Filing a chargeback without attempting to resolve the issue with us may result in immediate account suspension and loss of access to generated content.

Any billing disputes must be reported within 30 days of the charge to support@vibestory.ai.

5. Content Ownership

You retain all rights to the content you create using our Service, subject to the underlying AI model providers' terms and our license below.

By using the Service, you grant VibeStory a worldwide, non-exclusive license to use, display, and distribute your content solely for the purpose of operating and improving the Service.

6. Credits System

The Service operates on a credit-based system. Credits are consumed when generating images or videos. Unused monthly credits do not roll over to the next billing period unless explicitly stated in your plan.

Promotional Credits and Beta Bonus

Promotional credits, including any beta bonus credits:

• Are provided to new users during the beta period at our sole discretion
• Have no cash value and cannot be exchanged, transferred, or refunded
• Are non-transferable between accounts
• May expire according to the terms specified when granted
• Are subject to change or discontinuation without prior notice
• Cannot be combined with other promotional offers unless explicitly stated

Beta bonus terms and availability may vary by region and are subject to eligibility requirements determined by VibeStory.

7. Service Availability and Geographic Restrictions

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify or discontinue features with reasonable notice.

Geographic and Legal Restrictions

The Service may not be available in all countries or regions. Access to and use of the Service is restricted in:

• Countries subject to U.S. trade sanctions or embargoes
• Regions where AI-generated content is prohibited by local law
• Jurisdictions where we are legally prohibited from operating

You are responsible for compliance with all applicable local laws and regulations regarding the use of AI services and generated content. By using the Service, you represent that:

• You are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country
• You are not listed on any U.S. government list of prohibited or restricted parties
• Your use of the Service complies with all applicable export control laws and regulations

We reserve the right to restrict or terminate access to the Service based on geographic location or to comply with legal requirements.

8. Limitation of Liability

To the maximum extent permitted by law, VibeStory LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

9. Indemnification

You agree to indemnify and hold harmless VibeStory LLC from any claims arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

10. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Santa Clara County, California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
